BOOKING CONDITIONS
By proceeding with the booking of any model represented by The Brick Model Management, you are expressly agreeing to the following terms and conditions. Any amendment and/or variations made to these booking conditions shall not be valid unless The Brick has agreed to such in advance and confirmed such agreement by signing the booking confirmation form with the requested amendment and/or variation.
HOURS
•All rates are calculated from call time to wrap time and must be consecutive inclusive of reasonable breaks.
•A ‘day rate’ is calculated based on an 8-hour day. A model may be booked on an assignment for a negotiated rate of less than 8 hours upon request.
•Time-and-a-half applies after pre-negotiated hours, or 8 hours for a day rate, up to 12 hours. Hours to be worked past 12 hours are subject to approval by the model and double time rates apply. All bookings starting before 7 am or ending after 7 pm are subject to prior approval and potential overtime rates.
•Confirmed bookings canceled less than one calendar week from the shoot date are subject to a 50% cancellation fee. Confirmed bookings canceled within 3 calendar days from the shoot date require 100% payment.
•Weather permit cancellations made within 3 calendar days from the shoot date are half fee if services are immediately rescheduled and full fee if services are not immediately rescheduled.
PAYMENTS
•Payment for all bookings is due within 7 days of the booking date.
•A 20% agency service charge will be applied to billings. A 10% finance charge will be applied to billing unpaid within 7 days.
•All expenses incurred by The Brick or model on the client’s behalf will be charged to the client and will include a markup of 10% of the total amount of the expenses.
•Bookings involving lingerie, swimwear, nudity, sheer garments, fur, and/or cigarettes/alcohol must be negotiated and approved by The Brick before booking confirmation.
PROFESSIONAL SETTING
•All models are to be treated with respect and professionalism at all times. Any steps necessary must be taken to ensure that the safety, health, and well-being of the model are protected and maintained. No production member of a booking shall impose upon the model any action or activity that is either dangerous, degrading, unprofessional, or demeaning to the model.
•Models shall be provided with a private changing area at all times.
•Models shall be allowed to take a minimum of one 10-minute rest break per two hours worked, and an additional 30-minute meal break after 4 hours worked.
•Model’s appearance may not be permanently altered on a booking unless prior agreed to by The Brick in writing.
USAGE
•Usage rights are limited to the specific rights granted and may not be extended without approval and fee negotiation. Model social media fees must be specifically negotiated as a separate item and are not included in the standard web and electronic media usage terms.
•Unless agreed otherwise, a booking fee provides an entitlement and right for the use of one image via a single published medium for 6 months from the date of the booking, in the United States only, for the initial permitted use. Please note that such permitted use and entitlement are strictly subject to payment in full of all fees owed to The Brick before the image’s first use.
TEST SHOOTS
•All creatives’ requests for test shoots and photography sessions must be scheduled through The Brick. Contacting models directly to arrange a shoot, whether in person, or through phone, e-mail, or social networking sites, is not allowed.
•Parents or other family members are allowed to accompany models to test shoots and may stay through the entirety of the session.
•Test shoot content must be age-appropriate according to the model. Photographers should use their discretion. It is expressly prohibited from creating any materials in which the model appears nude or in which nudity is implied without the prior written consent of The Brick.
•Images should be submitted to The Brick directly and promptly, either within 2 weeks of the shoot or on a date agreed to both by The Brick and the photographer.
•All test shoots shall be usable for the creative team’s non-commercial promotion of their professional services solely on websites, social media platforms, and printed portfolios owned or controlled by the creative team member. Commercial advertisement for any products and/or services is not allowed unless a rate, fee, or form of payment has been established by The Brick.
